Company overview
Avature is a New York-based enterprise HR software company founded in 2004 by Dimitri Boylan, who co-founded HotJobs.com. It has offices in Buenos Aires, Madrid, London, Munich, Paris, Melbourne and Shenzhen. Its configurable Avature DNA platform covers recruiting CRM, ATS, high-volume and executive hiring, onboarding, internal mobility and performance management. Avature says its ATS is used by more than 650 organizations in over 130 markets, including 28 of the Forbes Global 100. AI runs throughout the platform: semantic search, weighted and explainable candidate matching and ranking, resume parsing, and candidate fraud detection. It also includes Avature Copilot, workflow agents (recruiter, hiring manager and an AI Interviewer) and a customer-facing Agent Builder. These run on a mix of third-party LLMs and Avature's own fine-tuned models.
Regulatory exposure
Avature's matching, ranking, screening and AI-interview features score and shortlist applicants. That puts them within the EU AI Act's Annex III recruitment category as high-risk, with obligations for these systems now deferred to December 2027 by the 2026 Digital Omnibus. They can also count as automated employment decision tools under NYC Local Law 144 when customers use them to substantially assist hiring for NYC roles. Avature has a large EU customer base, so as a provider it will owe Article 11 technical documentation, instructions for use and post-market monitoring. Its customers face Illinois' amended Human Rights Act (HB 3773, in force since January 2026), and the Illinois AI Video Interview Act if they use its video and AI Interviewer tools. Colorado's replacement automated-decision law (SB 26-189, effective January 2027) will require developers to give deployers documentation on intended uses, training-data categories, limitations and human review. Avature says it runs annual independent AEDT bias audits and has developed a Fundamental Rights Impact Assessment, but it publishes neither. Automated knock-out dispositioning, agent-driven dispositioning and a location-weighted match score all raise disparate-impact risk for deployers.
Path to a higher score
Publish the NYC LL 144 bias audit summaries Avature says it commissions each year: auditor, date, data used and impact ratios by sex and race/ethnicity, plus a downloadable report. Release the Fundamental Rights Impact Assessment and the AI data-governance policy it refers to. Ship public system cards and EU AI Act instructions for use for Matching, Candidate Fraud Detection and the AI Interviewer, covering intended purpose, training-data categories, known limitations and validated accuracy beyond the internal 80% top-10 figure. Pursue ISO/IEC 42001, and launch a public status page and an AI feature/model changelog. Publish deployer guidance and templates for NYC notices, Illinois and Colorado disclosures, and Article 26/27 obligations. Document human-approval gates for agent and knock-out dispositioning.
