Coderbyte Enterprise Inc. was founded in June 2012 and gives its address as Carlstadt, New Jersey. Its SOC 2 description puts its customer base at 3,000+ organizations hiring for technical roles. The core product is coding assessments graded automatically against test cases, plus live coding interviews. The AI features are optional. Each one is switched on per organization after it accepts an AI Terms Addendum. They grade take-home projects and free-form answers against editable rubrics, score resumes against AI-generated job criteria, run agentic phone screens (AWS Bedrock does the evaluation and ElevenLabs handles the audio) and add webcam proctoring with eye tracking, face detection and deepfake detection. Pricing starts at $99 a month or $1,799 a year. Enterprise plans start at $12,495 a year.
Regulatory exposure
Resume grading, agentic phone screens and AI grading of candidate work analyse applications and evaluate candidates, which puts them in the EU AI Act's Annex III point 4 high-risk category. The Digital AI Omnibus moved those duties to 2 December 2027 but did not change them. Coderbyte advises customers with EU AI Act concerns not to switch the AI features on, while its public DPIA calls its processing 'not likely to result in a high risk'. On NYC Local Law 144, the AI Terms bar customers from using AI output as a 'substantial factor' in consequential decisions. But the products output match scores and final scores built to prioritize candidates, and Coderbyte has published no bias audit. DCWP has promised tougher enforcement since the December 2025 Comptroller audit. Illinois has required notice of AI use in employment decisions since 1 January 2026, and video responses plus AI webcam proctoring may also bring in the AI Video Interview Act. The AI Terms leave every notice and consent to the customer. Colorado's SB 26-189 disclosure regime starts on 1 January 2027. California's FEHA rules require employers to keep records for four years, longer than Coderbyte keeps them: it deletes candidate data 90 days after a subscription lapses.
Path to a higher score
Coderbyte already publishes a downloadable SOC 2 Type 2 report, a DPIA and a data-flow diagram for each AI feature, so most of the gap is AI-specific evidence. The weakest category would rise most with an independent bias audit of resume grading, phone screens and AI project grading, plus a public summary in the Local Law 144 format and the adverse-impact results its validity page says it already collects. Technical documentation and data governance need model documentation for each AI feature: which Bedrock models it uses, what the confidence scores mean, its known limits, and whether names, contact details and zip codes are stripped from resumes. The remaining categories need an updated DPIA that treats resume and phone-screen scoring as high-risk, EU deployer guidance with a FRIA template in place of the advice not to use the features, candidate-notice templates for AI phone screens, and a public log of AI incidents and model changes.
