Company overview
Testlify, Inc. is a bootstrapped skills-assessment vendor based in the Philadelphia suburbs, with operations in India. Its privacy policy gives a Trevose, Pennsylvania address. LinkedIn lists a 2022 founding, while its About page traces the idea to 2021. It sells 3,500+ pre-built and AI-generated tests that feed an "objective, ranked leaderboard". It also offers an AI résumé screener that scores ATS applicants and can auto-advance or auto-reject them, AI-scored video, voice and chat interviews, and proctoring that includes facial-recognition identity matching. The Starter plan costs $139 a month, billed annually. A Scrut-hosted trust center lists SOC 2 Type 2 and ISO/IEC 27001:2022, with reports released on request. Its help center carries unusually candid responsible-AI guidance, but much of it contradicts the marketing and some product defaults.
Regulatory exposure
Scoring, ranking and auto-rejecting candidates makes Testlify a likely AEDT under NYC Local Law 144. It also places the product in the EU AI Act's Annex III high-risk category, whose obligations are now due on 2 December 2027. The only independent audit Testlify discloses covers its "Matching Model". It was completed on 16 June 2023, names no auditor and publishes no results, and Testlify's current fairness findings come from internal audits. NYC employers therefore have no audit from the past year to rely on, while DCWP has promised tougher enforcement. A nearer EU risk comes from help articles saying Video AI analyses "facial expressions… engagement" and one-way video scoring weighs "body language, and confidence". Deployers must check these features against the Article 5(1)(f) ban on workplace emotion recognition, in force since 2 February 2025. In Illinois, AI analysis of video interviews triggers the AI Video Interview Act's notice, consent and deletion duties, and HB 3773 notice duties have applied since January 2026. Face Match face scans also raise biometric-privacy duties that Testlify's identity-verification notice does not address. California's FEHA rules require four years of automated-decision records, yet Testlify auto-deletes recordings after 90 days and keeps logs for 30. Colorado's SB 26-189 disclosure duties start on 1 January 2027.
Path to a higher score
The fastest gains are: (1) commission a named, independent LL 144 audit that covers the résumé screener and AI interview scoring, publish the summary with impact ratios and dates, and repeat it every year; (2) state plainly whether any feature infers emotion or affect from faces, body language or voice, and remove those signals or disable them in the EU; (3) publish system cards that name the underlying AI models and providers, and add those providers to the subprocessor list; (4) make auto-reject and résumé auto-advance opt-in, with a human confirmation step; (5) add EU AI Act deployer guidance, such as instructions for use and a FRIA template, plus Illinois video-interview notice templates; (6) publish AI-specific monitoring, such as a model-change log and adverse-impact trend summaries, plus a security.txt or vulnerability-disclosure route. Dropping unsupported "bias-free" claims and the EEOC and EFPA badges would bring the marketing in line with Testlify's own help center.
