Company overview
eSkill Corporation, a Delaware company headquartered in San Antonio, Texas, says it has sold online employment testing since 2003. The SaaS fund Scaleworks bought it in July 2024, and Henry Tran is now CEO. The platform delivers auto-scored skills, cognitive and behavioral tests and human-rated one-way video interviews, and it is marketed to help employers screen out high volumes of poor-fit applicants. The AI has two parts. Linea, launched on 26 August 2026, uses Anthropic Claude models to draft assessments from job descriptions and an in-house embedding model to search the question library, and it works on the recruiter side only. An add-on powered by Proctorio records the candidate's webcam, audio and screen and produces an AI suspicion score.
Regulatory exposure
eSkill's scores are used to filter applicants, so most legal duties fall on employers as deployers. California's FEHA automated-decision-system rules (in force since 1 October 2025) explicitly cover computer-based tests of skills, aptitude and personality and require four years of record retention, but eSkill's terms keep scores for only up to a year after an account expires. In New York City, the AI suspicion score is the part most likely to count as an AEDT under Local Law 144 if employers use it to screen candidates out, and eSkill publishes no bias audit. Illinois HB 3773 has required notice of AI use since 1 January 2026, and AI analysis of webcam recordings may raise AI Video Interview Act questions. Under the EU AI Act, suspicion scoring evaluates candidates and falls under Annex III point 4, with obligations now due on 2 December 2027. Linea runs only on the recruiter side, so it has a stronger case for being a preparatory tool. Colorado's SB 26-189 disclosure regime starts on 1 January 2027.
Path to a higher score
The biggest gain would come from an independent, published bias audit with impact ratios by sex and race/ethnicity (including intersectional groups) for eSkill's standard tests, its behavioral assessments and the Proctorio suspicion score. It should be backed by criterion-validity and adverse-impact evidence, not only the content-validity review. eSkill should also update its privacy policy to cover webcam, audio, screen and photo-ID capture, and publish a subprocessor list naming Proctorio and Anthropic along with a DPA. Other gaps: a model card for the suspicion score explaining its inputs, thresholds and error rates; deployer guidance on the EU AI Act (including FRIA inputs) and on NYC, Illinois and Colorado duties, with candidate-notice templates; and a public status page with a security contact.
