Company overview
TestDome was founded in 2013 by Zeljko Svedic and Mario Zivic. Its legal entity, TestDome Ltd., is registered with the Commercial Court in Zagreb at Aleja lipa 1E, Croatia. LinkedIn and a +44 phone number present the company as London-based, but its legal pages name only the Zagreb entity. It also appoints a UK GDPR Article 27 representative, which a company established in the UK would not need. It sells pay-per-candidate skills tests at $7 to $20 per candidate with no subscription. Most answers are scored by fixed formulas. Open-ended TEXTAI answers are scored by AI, and prompt-engineering tasks are checked by GPT-4o on Azure. AI reviews webcam and screen proctoring recordings for signs of cheating. A Safe Exam Browser lockdown and a live code-interview tool are also offered. Data is hosted in Microsoft Azure's West Europe region (Netherlands).
Regulatory exposure
TestDome markets automatically scored tests with a configurable passing score to 'screen out weak applicants early'. When employers use them for New York City roles, they can count as an automated employment decision tool (AEDT) under NYC Local Law 144, which requires an annual independent bias audit and candidate notice. Under the EU AI Act they are high-risk AI (Annex III point 4). As an EU-established provider, TestDome will carry provider duties (technical documentation, human-oversight design, logging, post-market monitoring) once the deferred Annex III obligations apply on 2 December 2027. TestDome's own compliance guide says it publishes no independent bias audit and no EU AI Act deployer documentation. Its support site says its tests are not EEOC-validated for any specific job. GDPR Article 22 exposure arises when automated scores sort candidates into fail groups and trigger fail emails without a human review step. Illinois HB 3773 has required employer notice of AI use since 1 January 2026, yet TestDome's candidate help page does not mention AI scoring or AI analysis of recordings. Colorado's SB 26-189 disclosure regime (from 1 January 2027) also reaches US customers. So do California's FEHA automated-decision rules, which require four years of record retention; customers should check that duty against TestDome's 60-day auto-deletion of proctoring recordings. The proctoring AI looks for gaze, devices and extra people and does not appear to infer emotions, so the Article 5(1)(f) emotion-recognition ban does not appear to apply.
Path to a higher score
TestDome already publishes frank statements of its gaps, which gives it a clear roadmap. The biggest gains would come from five steps. (1) Commission and publish an independent bias audit, with impact ratios by sex and race/ethnicity, covering pass/fail outcomes on its most-used tests and the rates at which AI proctoring flags candidates. (2) Publish a system card for TEXTAI scoring, the GPT-4o validators and the proctoring model, with accuracy and false-positive rates and EU AI Act-style instructions for use. (3) Build and document a control that guarantees human review before a fail outcome, such as reviewer sign-off before fail emails and a reviewer override for AI-scored answers. (4) Publish deployer kits: candidate AI-notice templates for NYC, Illinois and Colorado, plus an EU AI Act and FRIA/DPIA support pack. (5) Add a public status page, a security.txt and vulnerability-disclosure policy for its stated bug bounty, and a changelog of AI model changes, and pursue SOC 2 or ISO 27001 and then ISO 42001.
