§ 05 - Editorial notes
Company overview
Alooba Pty Ltd was founded in 2019 by Tim Freestone and is based in New South Wales, Australia. It started as a data and analytics testing platform and in 2025 expanded to all business roles. Alooba Assess auto-grades SQL (with similarity-based partial credit), Python/R and multiple-choice tests. It sets each new assessment's pass mark to an 'Alooba Benchmark' drawn from historical scores, and customers can have it auto-reject candidates who score below their thresholds. Its AI features generate assessments from job descriptions, expand the question bank with LLMs, write candidate feedback and detect AI-written text. The Professional plan also lists an 'automated CV screening' feature that Alooba does not document anywhere. People grade free-response and video answers. Alooba Interview is a structured-interview tool scored by human interviewers, and Alooba Match is a recruitment service run by skills experts; neither is marketed as AI. Plans start at $250 a month.
Regulatory exposure
Alooba's help centre says it is not an automated employment decision tool (AEDT) under NYC Local Law 144, because its scoring 'is not derived from ML, AI, statistics' and customers keep discretion. That argument holds best for answer-key grading. It is weakest where a customer turns on score-threshold auto-rejection, which rejects and emails candidates 'eliminating the need for manual intervention', or keeps the statistically derived Benchmark as the pass mark. Alooba publishes no bias audit, so NYC employers carry that risk, and DCWP has committed to tougher enforcement. Under the EU AI Act, AI used to evaluate candidates is high-risk (Annex III point 4), with obligations now due on 2 December 2027. Alooba's AI-generated assessments, AI text detection and CV screening come closest to that line. Nothing it publishes suggests its webcam analysis infers emotions, which has been banned at work since February 2025. Its GDPR documents never address automated decisions such as score-based rejection. Several US rules reach customers who screen on its scores: Illinois HB 3773 notice duties (since 1 January 2026), Colorado's SB 26-189 disclosures (from 1 January 2027) and California's FEHA automated-decision rules (since 1 October 2025). Australia's 2024 Privacy Act amendments add automated-decision disclosures that Alooba's own privacy policy does not make. People score video answers, so the Illinois AI Video Interview Act turns on whether Alooba's undisclosed webcam analysis uses AI.
Path to a higher score
The biggest gain would be an independent bias audit of Alooba's most-used tests and auto-rejection thresholds. The anonymous gender, ethnicity and age data it already lets customers collect could support it. It should also revisit its not-an-AEDT position for accounts that use auto-rejection. It should document the Benchmark consistently: the help centre says roughly the 80th percentile, while the pricing FAQ says the 90th. It should also document the SQL partial-credit method and each AI feature, name the model providers and say whether candidate data reaches them. It should describe what the anti-cheating system flags and how accurate its AI text detection is. Candidates should be told about integrity flags and be able to contest them, the 'permanent' cheating record needs a retention limit, and auto-rejection needs human review or an appeal. Finally, it should publish its sub-processors, hosting locations, certifications and a security contact, keep a live incident history and changelog, and add EU AI Act deployer guidance with a FRIA template.
§ Regulatory frame
What applies to assessment ai.
Assessment is the most-regulated surface in AI hiring. NYC LL 144, EEOC and OFCCP frameworks, Illinois HB 3773, and EU AI Act Annex III §4 all apply, with overlap on bias-audit obligations.
