Company overview
Cappfinity Limited (formerly Centre of Applied Positive Psychology Limited, then CAPP & Co Limited) is a talent-assessment company. Psychologists Alex Linley and Nicky Garcea founded it in 2005. It is headquartered in Birmingham, UK, and has offices in London, Dublin (Cappfinity Ireland Limited), Houston and Sydney. It sells strengths- and skills-based assessments, numerical, verbal and critical reasoning tests, task-based job simulations, a digital assessment centre, and an asynchronous video interview platform where clients choose AI-assisted or human-led scoring. Its products are used heavily in graduate and early-careers hiring, and the client logos on its homepage include EY, Deloitte, HSBC, the NHS and Irish Rail. The platform is hosted on Microsoft Azure in Ireland and integrates with ATSs including Workday, Oracle, iCIMS and SmartRecruiters.
Regulatory exposure
Cappfinity's assessments score and filter candidates for recruitment. Wherever AI is involved, EU clients' use therefore falls into the EU AI Act's Annex III employment high-risk category, and Cappfinity's own FAQ acknowledges that 'high risk' classification. It has an Irish subsidiary and lists Irish Rail as a client. Its disclosures contradict each other. The video-interview page advertises AI-assisted scoring, and the FAQ lists optional AI for automating progression between stages and flagging candidates. The August 2026 privacy notice, by contrast, says Cappfinity does not use or rely on AI and describes its scoring as statistical algorithms rather than machine learning. In the US, where Cappfinity Inc. is based in Houston, AI-assisted video scoring or score-driven progression could qualify as an AEDT, which would oblige NYC employers to obtain annual Local Law 144 bias audits. AI analysis of video interviews also triggers the notice and consent duties of Illinois' Artificial Intelligence Video Interview Act. From 1 January 2027, Colorado's SB 26-189 will require developers to give deployers documentation on intended uses and on meaningful human review. We found no public bias audit, AI technical documentation or deployer guidance. Its main compliance assets are security certifications (ISO 27001, ISO 9001, Cyber Essentials Plus) and GDPR processor documents.
Path to a higher score
Cappfinity should first reconcile its AI disclosures into one accurate statement. It should then publish technical documentation for the AI-assisted video scoring and the progression and flagging features, covering inputs, training data, excluded signals, validation and limitations. It should commission and publish an independent bias audit with LL 144-style impact ratios for AI-assisted video scoring and score-based progression, and release the validity and adverse-impact evidence it currently shares only with clients. Its Trust Centre page is empty. Filling it with the ISO 27001, ISO 9001 and Cyber Essentials Plus certificates, pen-test summaries and AI documentation would help. It should also add EU AI Act instructions for use and FRIA and deployer guidance for public-sector clients, and document how assessors see, review and override AI scores in the product. Finally, it should clean up and link its Better Stack status page, removing the placeholder text and posting real incidents, and add a security.txt vulnerability-disclosure channel.
